CITY COUNCIL MEETING

MINUTES

MONDAY, AUGUST 9, 2010

 

I.                    CALL TO ORDER

 

A regular meeting of the City Council of the City of Liberty, Missouri was held in the Council Chambers at City Hall on August 9, 2010 with Mayor Greg Canuteson presiding.  Mayor Canuteson called the meeting to order at 7:00 p.m.

 

II.         INVOCATION AND PLEDGE OF ALLEGIANCE

 

            The invocation was given by Paul Jenness, who then led the pledge of allegiance.

 

III.       ROLL CALL

 

Roll call was answered by Paul Jenness, Ward I; Greg Duncan and Jeff Moore, Ward II; Lyndell Brenton and Jeff Watt, Ward III; and Fred Foster and Nick King, Ward IV.  Also in attendance were Curt Wenson, City Administrator; Dan Estes, Assistant City Administrator; Steve Hansen, Public Works Director; Steve Anderson, Planning and Development Director; Amy Brusven, Human Resources Director; Craig Knouse, Police Chief; Mike Snider, Interim Fire Chief; Dennis Dovel, Parks and Recreation Director; Karan Johnson, Economic and Business Development Manager; Shawnna Funderburk, Assistant to the City Administrator; Janet Pittman, Deputy City Clerk; Angie Borgedalen, Liberty Tribune; and 14 members of the public.

 

IV.       APPROVE MINUTES AND SUMMARIES (SEE CONSENT AGENDA)

 

A.                 SPECIAL SESSION MINUTES OF AUGUST 2, 2010

 

Council Member King moved to approve the minutes as distributed.  Council Member Watt seconded the motion, which carried 4-0-3.  Council Members Jenness, Brenton and Moore abstained due to absence.

 

B.                 EXECUTIVE SESSION MINUTES OF AUGUST 2, 2010

 

Council Member King moved to approve the minutes as distributed.  Council Member Duncan seconded the motion, which carried 4-0-3.  Council Members Jenness, Brenton and Moore abstained due to absence.

A.                 REGULAR SESSION MINUTES OF JULY 26, 2010

 

Council Member King moved to approve the minutes as distributed.  Council Member Jenness seconded the motion, which carried unanimously.

 

B.                 APPOINTMENTS

 

Liberty Housing Authority

Reappoint Bruce Ross to a term expiring 6-1-2014

 

Council Member King moved to approve the appointment.  Council Member Jenness seconded the motion, which carried unanimously.

 

VIII.     PUBLIC HEARINGS

 

A.         ESTABLISH THE LIBERTY CORNERS COMMUNITY IMPROVEMENT DISTRICT (CID) - ORDINANCE (to be continued to August 23)

 

Staff stated that the applicant has requested to continue this item until the August 23, 2010 Council Meeting.

 

Mayor Canuteson opened the public hearing.  Council Member Moore moved to continue the public hearing until August 23, 2010.  Council Member Brenton seconded the motion, which carried unanimously.

 

IX.       ORDINANCES, CONTRACTS AND RESOLUTIONS

 

A.        ORDINANCE ACKNOWLEDGING VENDOR PAYMENTS FOR THE PERIOD OF JULY 16, 2010 THROUGH JULY 30, 2010

 

In response to Council's questions regarding Northland Ready Mix, staff stated they will follow-up with Council regarding what type of contract labor this involved, and the requirement of an Occupational License.

 

Document No. 7195 was read.  Council Member King moved to approve the vendor payments.  Council Member Watt seconded the motion.  Vote on the motion was as follows:   Council Member Moore - yes; Council Member Brenton - yes; Council Member Foster - yes; Council Member Jenness - yes; Council Member Duncan - yes; Council Member Watt - yes; Council Member King - yes.  The motion carried unanimously; it was approved by the Chair and inscribed in Ordinance No. 9615.

 

B.         RESOLUTION HONORING KELLY MCCLELLAND AS THE CITY OF LIBERTY'S 2010 CIVIC LEADERSHIP AWARD RECIPIENT

 

Council Member Moore moved to approve the resolution.  Council Member Jenness seconded the motion, which carried unanimously and is inscribed in Resolution No. 2469.

 

C.                 AN ORDINANCE APPROVING REDEVELOPMENT PROJECT F (HY-VEE) OF THE LIBERTY TRIANGLE TAX INCREMENT FINANCING PLAN DATED MAY 24, 2007,  AS A REDEVELOPMENT PROJECT AND ADOPTING TAX INCREMENT FINANCING THEREIN

 

Document No. 7191 was read.  Council Member King moved to waive the rules and consider the ordinance on first reading.  Council Member Brenton seconded the motion, which carried unanimously.

 

Council Member Watt moved to approve the ordinance.  Council Member King seconded the motion, which carried unanimously.  It was approved by the Chair and is inscribed in Ordinance No. 9611.

 

D.                 TELECOM SETTLEMENTS

 

1.                   AN ORDINANCE APPROVING A SETTLEMENT AGREEMENT AND BINDING UNILATERAL AGREEMENT WITH CRICKET COMMUNICATIONS, INC., AND RELATED ENTITIES RELATING TO PAYMENT OF BUSINESS LICENSE TAXES - ORDINANCE

 

Document No. 7192 was read.  Council Member Brenton moved to waive the rules and consider the ordinance on first reading.  Council Member Jenness seconded the motion, which carried unanimously.

 

Council Member Watt moved to approve the ordinance.  Council Member King seconded the motion, which carried unanimously.  It was approved by the Chair and is inscribed in Ordinance No. 9612.

 

2.         AN ORDINANCE APPROVING A SETTLEMENT AGREEMENT AND BINDING UNILATERAL AGREEMENT WITH T-MOBILE RELATING TO PAYMENT OF BUSINESS LICENSE TAXES - ORDINANCE

 

Document No. 7193 was read.  Council Member Jenness moved to waive the rules and consider the ordinance on first reading.  Council Member Foster seconded the motion, which carried unanimously.

 

Council Member King moved to approve the ordinance.  Council Member Watt seconded the motion, which carried unanimously.  It was approved by the Chair and is inscribed in Ordinance No. 9613.

 

            E.         AN ORDINANCE AMENDING ORDINANCE NO. 9549 WHICH ESTABLISHED A TEMPORARY SINGLE FAMILY RESIDENTIAL HOMEBUILDING

                        INCENTIVE PROGRAM FOR THE CITY - ORDINANCE

 

Staff stated this amendment would extend the incentive program and raise the cap on the total number of homes that could qualify under the program from 30 to 40, and to allow each builder the opportunity to receive up to 10 speculative home permits at a time.

 

Document No. 7194 was read.  Council Member Brenton moved to waive the rules and consider the ordinance on first reading.  Council Member Jenness seconded the motion, which carried unanimously.

 

Council Member King moved to approve the ordinance.  Council Member Jenness seconded the motion, which carried unanimously.  It was approved by the Chair and is inscribed in Ordinance No. 9614.
