MINUTES
MONDAY, NOVEMBER 9, 2009
I.
CALL TO ORDER
A
regular meeting of the City Council of the City of Liberty, Missouri was held
in the Council Chambers at City Hall on November 9, 2009
with Mayor Greg Canuteson presiding. Mayor Canuteson called the meeting to
order at 7:00 p.m.
II. INVOCATION AND PLEDGE OF
ALLEGIANCE
The invocation
was given by Jeff Watt, who then led the pledge of allegiance.
III. ROLL CALL
Roll
call was answered by Paul Jenness and Harold Phillips, Ward I; Greg Duncan and Jeff
Moore, Ward II; Lyndell Brenton and Jeff Watt, Ward III; and Fred
Foster and Nick King, Ward IV. Also in attendance were Curt Wenson, City
Administrator; Steve Hansen, Public Works Director; Steve Anderson, Planning Director;
Amy Brusven, Human Resources Director; Craig Knouse, Police Chief; Gary Birch, Fire
Chief; Dennis Dovel, Parks and Recreation Director; Tony Sage, Information
Services Director; Shawnna Funderburk, Assistant to the City Administrator; Sara
Cooke, Communications Manager; Duane Davidson, Police Lieutenant; Janet Pittman,
Deputy City Clerk; Angie Borgedalen, Liberty Tribune; and 15 members of the
public.

V. CITIZENS?
PARTICIPATION
Cheryl McCann, 305
S. Missouri Street, spoke on behalf of
the Liberty?For All Green Taskforce. She stated the Taskforce?s goal is
betterment of the City?s trash and recycling programs. Earlier this year
Taskforce members met with Public Works staff regarding their goals. Staff
requested that the Taskforce contact Boulevard Brewing/Ripple Glass regarding a
new glass recycling program they were considering. Taskforce members contacted
Ripple Glass and determined they shared similar goals. As a result, last week
a glass recycling bin was dropped off at 400 Suddarth and Liberty
residents are now able to take advantage of this free service provided by
Ripple Glass. Ms. McCann stated the Taskforce is looking forward to assisting
City staff with new tasks.
Mayor
Canuteson read and presented proclamations to Natasha Stoneking and Bryce
McCloskey, congratulating them on being named Semifinalists by the National
Merit Scholar Program

ACKNOWLEDGEMENT OF VENDOR PAYMENTS
FROM OCTOBER 16, 2009 THROUGH OCTOBER 30, 2009

No. 7082 was read. Council Member King moved to approve the vendor payments.
Council Member Duncan seconded the motion. Vote on the motion was as follows:
Council Member Phillips ? yes; Council Member Moore ? yes; Council Member
Brenton ? yes; Council Member Foster ? yes; Council Member Jenness ? yes;
Council Member Duncan ? yes; Council Member Watt ? yes; Council Member King ?
yes. The motion carried unanimously; it was approved by the Chair and
inscribed in Ordinance No. 9511.
B.
AN ORDINANCE AMENDING THE OFFICIAL
ZONING MAP OF THE CITY OF LIBERTY, MISSOURI BY REZONING 8.14 ACRES LOCATED AT
2250 NORTH CHURCH FROM R-1A, SUBURBAN RESIDENTIAL DISTRICT TO BP,
BUSINESS PARK DISTRICT (second reading)
Council Member King moved to approve the ordinance.
Council Member Jenness seconded the motion, which carried 7-0-1. Council
Member Brenton abstained due to a potential conflict of interest. It was
approved by the Chair and is inscribed in Ordinance No. 9512.
C.
AN ORDINANCE ACCEPTING
A CONTRACT WITH GEORGE BUTLER ASSOCIATES, INC. FOR ENGINEERING SERVICES FOR THE
SANITARY SEWER REHABILITATION PROGRAM
Council discussed the proposed contract with George
Butler associates and the timeline of the project.
Document No. 7083 was read. Council Member King moved
to waive the rules and consider the ordinance on first reading. Council Member
Phillips seconded the motion, which carried unanimously.
Council Member Brenton moved to approve the ordinance.
Council Member Moore seconded the motion, which carried unanimously. It was
approved by the Chair and is inscribed in Ordinance No. 9513.
D.
AN ORDINANCE AMENDING CHAPTER 22,
?OFFENSES ? MISCELLANEOUS?, SECTION 22-3 OF THE CODE OF THE CITY OF LIBERTY, CLAY COUNTY, MISSOURI
Council discussed the proposed ordinance amending
Chapter 22, replacing section 22-3 ?Assault or Breach of Peach Prohibited? with
a new Section 22-3 ?Assault?. The proposed amendment, which defines assault,
mirrors state Statutes.
Document No. 7084 was read. Council Member Brenton
moved to waive the rules and consider the ordinance on first reading. Council
Member Jenness seconded the motion, which carried unanimously.
Council Member Brenton moved to approve the
ordinance. Council Member Duncan seconded the motion, which carried
unanimously. It was approved by the Chair and is inscribed in Ordinance No. 9514.
E.
AN ORDINANCE AMENDING CHAPTER 22,
?OFFENSES ? MISCELLANEOUS?, SECTION 22-30, OF THE CODE OF THE CITY OF LIBERTY,
CLAY COUNTY, MISSOURI
Council discussed the proposed ordinance amending
Chapter 22, replacing Section 22-30 ?Injury, etc., to trees, city property,
etc., prohibited? with a new Section 22-30 ?Vandalism?. The proposed
amendment, which defines vandalism, mirrors state Statutes.
Document No. 7085 was read. Council Member Phillips
moved to waive the rules and consider the ordinance on first reading. Council
Member Jenness seconded the motion, which carried unanimously.
Council Member Watt moved to approve the ordinance.
Council Member Jenness seconded the motion, which carried unanimously. It was
approved by the Chair and is inscribed in Ordinance No. 9515.
F.
AN ORDINANCE AMENDING CHAPTER 20,
?MOTOR VEHICLES AND TRAFFIC?, OF THE CODE OF THE CITY OF LIBERTY, CLAY COUNTY, MISSOURI
Council discussed the proposed ordinance amending
Chapter 20, replacing Section 20-35.2 with a new Section 20-35.2 ?Child
Passenger Restraint Systems?.
Document No. 7086 was read. Council Member Jenness
moved to waive the rules and consider the ordinance on first reading. Council
Member Foster seconded the motion, which did not carry unanimously. Mayor
Canuteson stated that this item would be on second reading at the November 23, 2009
meeting.
X. OTHER BUSINESS
XI.
MISCELLANEOUS MATTERS FROM CITY
ADMINISTRATOR
City Administrator Curt Wenson stated that
the Community Christmas Tree Lighting Ceremony, which serves as a kick-off for
the program which lends a hand to disadvantaged Liberty families and seniors
during the holiday season, will be held on November 20 at 6:00 p.m. on the
Square. Also, on December 12 from 1:00 ?
6:00 p.m. the Parks Charitable Fund will
host a Winter Carnival at the Community Center. The proceeds will go to
benefit the Charitable Fund?s youth scholarship program.
XII.
MISCELLANEOUS MATTERS FROM MAYOR AND CITY COUNCIL
Mayor
Canuteson and the City Council thanked Ms. McCann and the Green Taskforce
members for their efforts. Council also thanked TreeLiberty and the Tree
Board volunteers for mulching around the trees along South Liberty Parkway.
Mayor
Canuteson stated he would be serving on a Clay County economic task force, focusing on the manufacturing
industry. The Mayor noted he had also been appointed by the Governor to the
Missouri Hazardous Waste Management Commission.
